1) Overview

These Terms of Service (“Terms”) govern your access to and use of the WineYourSign website, applications, and related content and services (collectively, the “Service”). By using the Service, you agree to these Terms and to our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree, do not use the Service.

2) Eligibility & Alcohol Responsibility

  • 21+ only. The Service is intended solely for individuals 21 years of age or older. If you are under 21, do not use the Service.
  • No alcohol sales. WineYourSign does not sell alcohol. “Where to buy” links lead to third-party retailers who independently handle products, pricing, taxes, shipping, and age verification.
  • Your obligations. You are responsible for complying with all laws where you use the Service (including alcohol laws) and for ensuring any purchases or gifts are not provided to anyone under the legal drinking age.

3) Accounts & Security

Some features (e.g., saving your birthdate/region, Premium features) may require an account.

  • Accuracy. Provide accurate, current information and keep it updated.
  • Security. You’re responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of unauthorized use.
  • Termination. We may suspend or terminate your account or access at any time, with or without notice, including for breach, suspected fraud, or misuse.

4) Paid Features; Pricing & Changes; Cancellation

  • Pricing & taxes. Pricing for paid features (e.g., Premium) is displayed at purchase and may vary by region, platform, promotions, and applicable taxes/fees. We may change prices, with legally required notice where applicable.
  • Auto-renewal. Subscriptions auto-renew until you cancel. You can cancel at any time via the method shown at purchase (e.g., account settings or app-store subscription settings). Cancellation takes effect at the end of the current billing period.
  • Payment processing. Payments are handled by third-party processors; we do not store full payment card details.

5) Refunds & Right of Withdrawal

We aim to minimize friction while complying with mandatory consumer-protection laws:

  • General rule. Except where required by law or where expressly stated at checkout, fees are non-refundable, and partially used periods are not prorated.
  • Platform purchases. If you purchased via a platform (e.g., Apple App Store / Google Play), that platform’s refund policies control; request any refund through the platform.
  • Statutory rights (examples). If your local law grants a cooling-off/withdrawal right for digital services (e.g., certain EEA/UK residents), we will honor it as applicable—subject to lawful exceptions (for example, if you requested immediate access and acknowledged losing the withdrawal right).
  • Non-conformity. If the Service is unavailable or non-conforming in a way that triggers non-waivable legal remedies where you live, we will provide the remedy required by law (which may include repair, replacement, or refund).
  • How to request. For direct purchases from us, email contact@wineyoursign.com with your order email, date, and reason. For platform purchases, contact the platform.

Nothing in this Section limits any non-waivable rights you may have under applicable law; where local law is more protective, it controls.

6) Recommendations & Disclaimers

  • Entertainment & discovery. WineYourSign provides astrology-informed wine recommendations for entertainment and discovery.
  • No guarantees. We do not guarantee the accuracy, availability, or suitability of any recommendation, nor that any specific bottle will be available in your region or at a given price.
  • Professional curation. Where noted, suggestions may be curated or reviewed by wine professionals; this does not create a warranty.

7) Third-Party Links & Services

  • Outbound links. “Where to buy” links lead to third-party websites we do not control. Those parties are solely responsible for their content, products, pricing, compliance, and customer service.
  • No endorsement/agency. Links do not imply endorsement, partnership, or agency unless we explicitly state so.
  • Your relationship. Your transactions are with the third-party retailer, not WineYourSign.

8) Privacy & Cookies

Your use of the Service is subject to our Privacy Policy (data practices) and Cookie Policy (cookies/trackers), each incorporated herein.

9) Acceptable Use

You agree not to: (a) use the Service if under 21; (b) violate any law; (c) access accounts or data without authorization; (d) interfere with or disrupt the Service or impose unreasonable load; (e) deploy malware, automated scraping, or similar without permission; (f) post unlawful, infringing, defamatory, hateful, or obscene content; (g) reverse-engineer or attempt to derive source code except where permitted by law. We may investigate and take action, including content removal or access restrictions.

10) User Content & Feedback

If you submit reviews, comments, testimonials, or other content (“User Content”):

  • License. You grant WineYourSign a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, adapt, publish, translate, distribute, and display such content in connection with the Service and our business (including marketing) in any media.
  • Your promises. You represent you own or have rights to your content and that it complies with law.
  • Moderation. We may moderate or remove User Content at our discretion.

11) Intellectual Property; Limited License

The Service (including software, text, graphics, logos, and trademarks) is owned by WineYourSign and its licensors and protected by IP laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. No other rights are granted.

12) Age Handling in Flows

  • Your horoscope. When you request your horoscope, we may rely on your provided birthdate for an age check; if it indicates you are under 21, your request will be refused.
  • Friend/spouse gift flow. You must be 21+ to use it. We do not verify a friend’s age—do not purchase or gift alcohol for anyone under the legal drinking age.
  • Region. Region detection is approximate; registered users may set a preferred region. Availability varies.

13) Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINEYOURSIGN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINEYOURSIGN AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR THIRD-PARTY SITES. IN NO EVENT WILL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF US $50 OR THE AMOUNTS YOU PAID TO WINEYOURSIGN (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow certain limitations; where prohibited, the limitations apply to the fullest extent permitted.

15) Indemnification

You agree to indemnify, defend, and hold harmless WineYourSign and its affiliates, officers, directors, employees, agents, and licensors from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, violation of these Terms, violation of law, or User Content.

16) Changes to the Service & Terms

We may modify or discontinue the Service (in whole or part) and update these Terms at any time. Material changes will be indicated by updating the Effective Date or by additional notice where required by law. Continued use after changes take effect constitutes acceptance.

17) Dispute Resolution — Arbitration (Washington; FAA); Class Waiver

Please read carefully—this affects your rights.

  1. Governing law. Except as preempted by the U.S. Federal Arbitration Act (“FAA”), these Terms are governed by the laws of the State of Washington, without regard to conflict-of-laws rules.
  2. Informal resolution. Before filing a claim, email contact@wineyoursign.com with a brief description of the dispute and your contact information. We will try to resolve it within 30 days.
  3. Arbitration. If not resolved, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by this Section.
  4. Seat, venue, language. The seat of arbitration is King County, Washington; any in-person hearing occurs in Seattle, Washington; proceedings are in English.
  5. Individual basis only. No class actions or class arbitration. YOU AND WINEYOURSIGN AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE-ATTORNEY-GENERAL PROCEEDING.
  6. Small-claims option. Either party may bring an individual action in small-claims court in King County, Washington instead of arbitration.
  7. Fees & costs. AAA rules govern payment of filing, administration, and arbitrator fees. We will consider good-faith requests to reimburse reasonable fees if your claim is not frivolous.
  8. Severability. If the class waiver in 17(5) is found unenforceable, this entire Section 17 is void, and the dispute will proceed in the state or federal courts in King County, Washington.
  9. Opt-out. You may opt out of arbitration by emailing contact@wineyoursign.com with subject “Arbitration Opt-Out,” your full name, and your account email within 30 days of first accepting these Terms.
  10. Injunctive/IP relief. Either party may seek temporary or preliminary injunctive relief in court to protect rights pending arbitration (e.g., misuse of IP, unauthorized access).

18) DMCA / IP Notices

If you believe material on the Service infringes your copyright, email contact@wineyoursign.com with: (a) identification of the copyrighted work and the material claimed to be infringing; (b) your contact information; (c) a statement of good-faith belief; and (d) a statement under penalty of perjury that you are authorized to act.

19) Export & Sanctions

You agree to comply with all applicable U.S. export control and sanctions laws and not to use the Service in or for the benefit of embargoed countries or prohibited parties.

20) Electronic Communications; Notices

You consent to receive communications from us electronically (e.g., email, in-product messages). Legal notices to WineYourSign must be sent to the address above and to contact@wineyoursign.com.

21) Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

22) Entire Agreement; Severability; Waiver; Language

These Terms (including policies incorporated by reference) constitute the entire agreement between you and WineYourSign regarding the Service. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver. English is the controlling language; translations (if any) are for convenience only.
